Combate à corrupção: a aplicação de mecanismos internacionais no direito brasileiro

Resumo

O combate à corrupção é um dos grandes temas que se encontra presente nas agendas no ambiente das relações internacionais. Tida como inimiga do livre comércio e do desenvolvimento econômico, o seu combate nas últimas décadas tem se fortificado, havendo uma grande gama de instrumentos internacionais que auxiliam as ações anticorruptivas. O presente artigo visa analisar os instrumentos internacionais e como o Brasil, através da Lei nº 12.846/2013, se posicionou a respeito de combate ao suborno a funcionários públicos estrangeiros, desta forma, havendo grande interdisciplinaridade entre as áreas do Direito Empresarial, Direito Internacional e Direito Administrativo. O artigo se divide em três momentos: inicialmente apresenta-se introdução ao tema, demonstrando a relevância do seu estudo; em seguida, passa-se à análise do FCPA – Foreign Corrupt Practices Act e dos Instrumentos Internacionais Anticorrupção; por fim, apresenta-se a posição brasileira, ao se adotar a Lei nº 12.846/2013. O trabalho demonstra que o combate à corrupção necessita de cooperação internacional e da evolução destes instrumentos.

ABSTRACT

The fight against corruption is one of the great themes that is present in the agendas of the international relations. As an enemy of free trade and economic development, its struggle over the last few decades has been strengthened, with a wide range of international instruments that support anticorruption actions. This article aims to analyze the international instruments and how Brazil, through Law 12.846/2013, was positioned on the fight against bribery of foreign public officials, in this way, there being great interdisciplinarity between the areas of Business Law, International Law and Administrative Law. The article is divided in three moments: initially introduces itself to the subject, demonstrating the relevance of its study; then it is analyzed by the FCPA - Foreign Corrupt Practices Act and the International AntiCorruption Instruments; Finally, the Brazilian position is presented, when adopting Law 12,846/2013. The work shows that the fight against corruption needs international cooperation and the evolution of these instruments.
